1) SWEEPSTAKES TIMING: Ginny’s “Best Holiday Ever” Sweepstakes” (the “Sweepstakes”) starts July 1, 2011 at 12:00:01 AM Central Daylight Time (CDT) and ends September 30, 2011 at 11:59:59 PM CDT (the "Sweepstakes Period"). Early Bird Entry ends July 31, 2011 at 11:59:59 PM CDT. The Promotion will include two (2) prize drawings: An Early Bird Drawing to award twenty-five (25) Early Bird Prizes (1 each to 25 individual winners) and a Sweepstakes Drawing to select one (1) Grand Prize, five (5) First Prize, ten (10) Second prize and fifteen (15) Third Prize Winners. Limit one (1) entry per person during the Sweepstakes Period. Eligible entries received from the Early Bird Drawing will be added to the Sweepstakes Drawing. The database administrator’s computer is the official timekeeper for this Sweepstakes.

2) ELIGIBILITY: This Sweepstakes is offered and open only to persons legally residing in one of the fifty (50) United States, the District of Columbia, or Puerto Rico who are at least 21 years of age on the date of entry in this Sweepstakes. Officers, directors and employees of Ginny’s, (“Sponsor”), Marden-Kane, Inc. (“Administrator”), Pinnacle Promotion Group and each of their respective parent, subsidiary and affiliated companies, distributors, advertising, promotional and judging agencies, persons engaged in the development, production or distribution of materials for this Sweepstakes (collectively, the “Promotion Entities”) and the immediate family members (parent, child, sibling, and spouse of each) of and/or persons living in the same household as such individuals (whether related or not) are not eligible to participate. 2. You can call the toll-free number 1-800-693-0809. You will be asked to provide name, address, age, city, state, zip code, telephone number, email address and gender (optional.) You must call the specified phone number noted above and provide all required information to be eligible for the Early Bird Drawing (if submitted before 8/1/11) or Sweepstakes (if submitted before 10/1/11). Sponsor and Promotion Entities are not responsible for inability of caller to complete call within Sweepstakes Period, whether due to busy lines, disconnections, telephone malfunctions, service interruptions or other circumstances, or for any human error in gathering required information.

To enter either way, you must provide the requested information to be eligible. As part of the Sweepstakes entry process, entrants will be required to indicate that they have read, accept, and agree to be bound by these Official Rules including that they are at least 21 years of age. Limit one (1) entry per person during the Sweepstakes Period regardless of entry method. Any individual who attempts to enter, or in the sole discretion of Sponsor is suspected of entering more than once or submits entries in excess of the disclosed maximum, by any means, including but not limited to establishing multiple email accounts, will be disqualified from participation in this Sweepstakes. More than one person may not enter a prize drawing on the same computer at any time during the Sweepstakes Period. Limit of one early bird prize and one Sweepstakes prize per person. In the event of a dispute over the identity of any potential winner, the entry will be declared made by the authorized account holder of the email address/phone number submitted at the time of entry, and potential winner may be required to provide identification sufficient to show that he/she is the authorized account holder of such email address/phone number. 4) PRIZE DRAWINGS AND NOTIFICATIONS. Early Bird Drawing: A random drawing to select twenty-five (25) potential early bird winners will be conducted on or about August 8, 2011, as determined by Sponsor, from among all eligible entries received on or before July 31, 2011. Odds of winning an Early Bird prize depends upon the total number of eligible entries received for the early bird drawing. Sweepstakes Drawing: A random drawing to select one (1) Grand Prize, five (5) First Prize, ten (10) Second prize and fifteen (15) Third Prize Winners will be conducted on or about October 7, 2011 from among all eligible entries received during the Sweepstakes Period (includes eligible entries received during the early bird drawing). The drawings will be conducted by Marden-Kane, an independent judging organization whose decisions are final and binding on all matters relating to this Sweepstakes. Odds of winning a prize in the Sweepstakes Drawing depends upon the total number of eligible entries received during the Sweepstakes Period. Potential winners are subject to eligibility verification and compliance with these Official Rules. Marden-Kane will attempt to notify each potential Prize Winner via email and or phone within one (1) day of the prize drawing using the email address or phone number provided at time of entry. Each potential Prize Winner will be required to provide mailing address information (e.g. full name, street address, city, state, and ZIP) along with age verification within seven (7) days of notification in order to receive prize delivery. 5) PRIZES: Twenty-five (25) Early Bird Prizes: A Ginny's 10-Speed Blender. Approximate retail value (“ARV”) of the Prize is $39.95 USD each.
Sweepstakes Prizes: One (1) Grand Prize: 8 day/ 7 night Vacation Package for up to twelve (12) persons to Orlando, FL. Includes round-trip coach airline tickets for winner and up to eleven (11) guests from major domestic airport nearest the winner’s and guests’ homes to Orlando, FL; accommodations at Emerald Island Resort (6 BR, 4.5 BA) in Kissimmee, FL; admissions to an Orlando theme park for three (3) days; and $1,470 in spending money. The $1,470 includes roundtrip transportation for three days to theme parks, theme park meals and groceries. ARV: $18,470 USD.

Actual value may vary based on travel dates and winner's point of departure. Any difference between approximate value and actual value of the trip will not be awarded in cash. If winner or guest(s) lives within a 150-mile radius of prize destination, ground transportation may be provided in lieu of air transportation and no compensation or substitution will be provided for difference in prize value. Winner is responsible for all taxes, transportation, fees, meals, personal expenses, incidentals and other expenses not expressly listed above. Grand prize trip must be taken at time and flight itinerary specified by Sponsor or prize will be forfeited in its entirety. Grand prize winner and guests are also responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that the Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. Winner and guests assume responsibility for any and all damages, losses or injuries of any kind that may arise. Certain blackout dates and travel restrictions may apply. Award travel must take place between 12/24/11 and 12/31/11. However, if winner is unable to travel during this time, winner will have the option of redeeming the prize within one (1) year from the date the prize was awarded and is wholly dependent on availability of property as determined by Discount Rental Villas (“DVRO”) in Orlando, FL. Winner assumes all responsibility for contacting DVRO and reserving rental property. Prizes may not be sold, bartered, or exchanged by any winner. All details of any prize not specified herein shall be determined solely by Sponsor. Any and all guarantees and warranties for Prizes are subject to the manufacturer’s terms and conditions and the Winners agree to look solely to such manufacturer for any such warranty or guarantee claim. By accepting a prize, each winner acknowledges compliance with these Official Rules. If winner is found to have falsified any data or material, winner forfeits its prize and is disqualified, and an alternate winner will be selected according to the original winner selection method. All federal, state, or other tax liabilities arising from this Sweepstakes are the sole responsibility of each respective prize winner. The Potential Grand Prize Winner will be required to execute an Affidavit of Eligibility and Publicity/Liability/Travel Release (the “Affidavit”), where lawful, prior to being awarded the prize, which must be returned within three (3) days of receipt of the Affidavit by the potential Grand Prize Winner. Prize award is subject to verification of Potential Grand Prize Winner’s identity and eligibility to Sponsor’s satisfaction. If prize notification is refused, not responded to within three (3) days after notification, or the potential prize Winner is ineligible, such potential prize Winner will be disqualified and an alternate Winner will be randomly selected. Upon disqualification, no compensation will be given. Each guest of the Grand Prize Winner must also sign and return a Travel Release prior to the issuance of travel documents. A guest who is a minor in his/her jurisdiction of residence must be accompanied on the trip by a guest who is the parent, grandparent or legal guardian of the minor. A minor’s Travel Release must be completed on his/her behalf by a parent/legal guardian. In addition to these documents, Grand Prize Winner will be required to sign an Accidental Damage Waiver document. Any expenses incurred by damage or theft found by the management company upon the departure of the guest will be directly collected from the guest and charged to the credit card(s) on file for the reservation. The guest is responsible for any damage to the home or items within or placed upon the property during their stay. The expense to repair or replace such items will be charged to the guest directly by the management company, direct owner of the vacation property or third party supplier such as DVRO, as the guest`s proper billing information will be provided to the supplier for the guest responsible. It is understood by all parties that excessive damage is considered malicious. Malicious damage and theft will be reported to authorities without exception. The guest will be held responsible for any additional expenses resulting from malicious damages and/or theft, and will be subject to the terms and conditions of the management company involved. The guest agrees and accepts liability for damages and/or theft caused by their party and agrees the charges made to the credit card provided by the guest, will not be disputed.

The accidental damage waiver does not cover theft, gross negligence, willful or wanton conduct, intentional damage, lost keys, stolen pool or spa heat utility usage, additional cleaning fees due to excessive trash, unauthorized early check in or late check out, pets, smoking, or any other violation of the rental policies. Additionally, you authorize DVRO and the management company of the vacation property reserved for your stay, to charge the credit card on file with any additional damage payments.

6) CONDUCT: This Sweepstakes is subject to all federal, state and local laws/regulations. By entering this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the judges that shall be final and binding in all respects. These Official Rules are accessible from www.ginnys.com/holiday. Failure to comply with these Official Rules may result in disqualification. Sponsor reserves the right at its sole discretion to disqualify any individual suspected of tampering with the entry process or the operation of the Sweepstakes; or to be acting in any manner deemed by Sponsor to be in violation of the Official Rules; or to be acting in any manner deemed by Sponsor to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person. 7) LIMITATIONS OF LIABILITY: Promotion Entities, assume no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty, failed, garbled or jumbled electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Sweepstakes; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the Sweepstakes; (d) inaccessibility or unavailability of the Internet or any combination thereof, or; (e) any injury or damage to participant’s or to any other person's electronic device which may be related to or resulting from any attempt to participate in the Sweepstakes or download any materials in the Sweepstakes. In no event will more than the stated number of prizes be awarded. If, for any reason, the Sweepstakes is not capable of running as planned for reasons which may include without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes (subject to the approval of DACO in Puerto Rico), in whole or in part.

8) ENTRANT RELEASES: All entrants, as a condition of entry into the Sweepstakes, agree to release Promotion Entities, and their respective parents, subsidiaries, affiliates, divisions, distributors, suppliers, printers, application developers, distributors and advertising, promotional or judging agencies, from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with accessing the Sweepstakes page; submitting an entry or otherwise participating in any aspect of the Sweepstakes; the receipt, ownership or use of any prize awarded; preparing for, participating in or traveling to and/or from any prize-related activity, or any typographical or other error in these Official Rules or the announcement of offering of any prize. The winner shall bear all risk of loss or damage to their prize after it has been delivered. 9) DISPUTES: Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the United States and the State of Wisconsin, without giving effect to any choice of law or conflict of law rules (whether of the State of Wisconsin, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Wisconsin.

Except where prohibited, as a condition of participating in this Sweepstakes, each participant agrees that any and all disputes that cannot be resolved between the participant and any Released Party, claims and causes of action arising out of or connected with this Sweepstakes, or the prize awarded, or the determination of the winner must be resolved individually, without resort to any form of class action. Further, in any such dispute, under no circumstances will a participant be permitted or entitled to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than participant’s actual out-pocket expenses (if any), and participant further waives all rights to have damages multiplied or increased.
